FSCA, FAIS and POPIA: Navigating the SA Regulatory Framework for Marine Insurance

South Africa's financial services industry is regulated by a comprehensive framework designed to protect consumers and ensure market integrity. Understanding this framework helps boat owners navigate the insurance market with confidence, verify that their insurer and broker are operating legitimately, and know their rights when things go wrong.

The Financial Sector Conduct Authority (FSCA)

The Financial Sector Conduct Authority (FSCA) is South Africa's market conduct regulator for financial services. The FSCA replaced the Financial Services Board (FSB) in 2018 and is responsible for supervising the conduct of financial institutions to ensure fair treatment of customers.

For marine insurance, the FSCA's role means that insurers offering coverage in South Africa must be licensed and meet ongoing conduct requirements. You can verify an insurer's or broker's FSP (Financial Services Provider) licence on the FSCA's online register at www.fsca.co.za. Before accepting a quote or signing a policy, confirm that the financial services provider holds a valid FSP licence.

The FAIS Act (Financial Advisory and Intermediary Services Act 37 of 2002)

The FAIS Act governs the conduct of financial service providers in South Africa, including insurance brokers and advisers. Under FAIS, any person or entity that provides financial advice or acts as an intermediary in insurance transactions must hold an appropriate FSP licence.

For boat owners, FAIS means that when you deal with a licensed insurance broker, they have obligations to you as a client. These include disclosing their FSP number, informing you of any commissions earned, recommending suitable products, and handling your information responsibly. Brokers must provide you with a record of advice — a written document outlining the advice given and the basis for any recommendations.

If you have a complaint about an FSP, you can report it to the FSCA or approach the FAIS Ombud for dispute resolution.

POPIA and Your Personal Information

The Protection of Personal Information Act 4 of 2013 (POPIA) is South Africa's primary data protection legislation, modelled in part on the European GDPR. POPIA came into full effect in July 2021 and gives you rights over how your personal information is collected, stored, and used.

When you submit a yacht insurance quote request, the following principles apply: your information should only be collected for a specific, legitimate purpose; it should be kept accurate and up to date; you should be informed about how it will be used; and it should be kept securely.

Under POPIA, you have the right to access your personal information held by an insurer, correct inaccurate information, and in certain circumstances, request deletion of your data. Reputable SA insurers and brokers will have a documented privacy policy compliant with POPIA available on their website.

The Ombudsman for Short-Term Insurance

If you have a dispute with your short-term insurer — including marine insurers — and cannot resolve it directly, you can approach the Ombudsman for Short-Term Insurance (OSTI). The OSTI provides a free dispute resolution service for consumers. The process is straightforward: you must first attempt to resolve the complaint directly with your insurer before escalating to the OSTI.

Referral Services and Regulatory Compliance

Referral services that connect boat owners with licensed brokers and advisers play an important role in the SA marine insurance market. While referral platforms are not themselves regulated as FSPs (provided they do not provide financial advice), the advisers and brokers they refer you to must hold valid FSCA licences. When using any referral service, confirm that the brokers you are connected with are licensed before providing personal or financial information.
